Hot Fix Terms of Use

These terms are an agreement between you and Strange Matter Studio LLC, an Illinois limited liability company ("we", "us"), about playing Hot Fix (the "Game"). By downloading or playing the Game, you agree to them. If you don't agree, please don't play.

Who may play

The Game is made for a general audience. If you are under the age of majority where you live, a parent or guardian should read these terms with you and approve any purchase.

Your license

We give you a personal, non-exclusive, non-transferable, revocable license to download the Game and play it for your own non-commercial entertainment, on devices you own or control. The license is limited by these terms and by the rules of the store you got the Game from.

You may not:

• copy, sell, rent or share the Game, or distribute modified versions of it;
• reverse-engineer, decompile or try to get the Game's source code, except where the law allows it;
• cheat, or use bots, exploits, modified clients or tools that change how the Game works or how it talks to our servers;
• buy, sell or trade accounts or in-game items outside the Game;
• use the Game to break the law or to harm anyone.

We may suspend or end your access, or reset items gained by cheating, if you break these terms. You can stop at any time by deleting the Game (and, once accounts exist, your account).

Ownership

The Game and everything in it are owned by Strange Matter Studio LLC or its licensors. That includes the code, 3D models, art, music, characters, names and jobs. Apart from the license above, these terms give you no rights to any of it.

Virtual items and currencies

Solder, Flux, Fuses, Parts, cosmetics, passes and other items in the Game are a limited license to use content in the Game. They are not money or property, have no cash value, can't be exchanged for money, and can't be transferred outside the Game. We may change how they work, for example for game balance.

If the Game offers purchases: you buy them through Apple or Google, under their payment terms and refund policies. Purchases are final except as the store's refund policy or the law provides. Items with random contents show their odds before you buy.

Accounts and progress

Today your progress is stored on your device, and is lost if you delete the Game or lose the device. When online saving is available, you are responsible for keeping access to your sign-in, and you can delete your account in the Game.

Events with other players

If the Game runs competitive events, we may set rules for them and remove results that break those rules or these terms. Event rewards are virtual items under the section above.

Game Center

On Apple devices, Game Center is Apple's service and its terms apply to it.

Changes and availability

We may update the Game, change or remove features, or stop offering it. We'll try to give notice before a major change, and before we turn off anything you paid for. We don't promise that the Game will always be available or free of errors.

Store terms

App Store. If you downloaded the Game from Apple's App Store, Apple's Licensed Application End User License Agreement also applies, and these terms add to it.

• These terms are between you and us, not Apple, and we, not Apple, are responsible for the Game and its support.
• Apple has no obligation to maintain or support the Game.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

Google Play. If you downloaded the Game from Google Play, Google Play's terms of service also apply.

No warranty

The Game is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

Limit of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special or consequential damages, or for loss of data or virtual items, arising from your use of the Game. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.

Law

These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law rules. This doesn't take away any rights you have under the consumer protection laws where you live.

Privacy

How the Game handles information is explained in the Hot Fix Privacy Policy, at strangematter.dev/hotfix/privacy.

Changes to these terms

If we change these terms, we'll post the new version at the same address with a new effective date, and tell you in the Game if a change is significant. Continuing to play after a change means you accept it.
